The terms and conditions mentioned on this page determine the terms associated with usage of the website https://kailashvisiontreks.com/ and the services associated with our website. By using our website and services, you agree to be bound by the agreement mentioned on this page. Do note that these conditions are applicable in any and all circumstances unless mentioned specifically otherwise or agreed between the two parties in written form. Any previous dealings between you and any of our members do not change the specific conditions mentioned on this website. 

Booking Process And Advanced Deposit 

To confirm your booking, you must:

  • Fill out our official Booking Form completely and accurately.
  • Pay a non-refundable advance deposit.

Your booking is confirmed only after we receive the completed Booking Form and the advance deposit. Please note that this deposit is non-refundable under any circumstances as it is used to secure accommodations, transportation, permits, and other services.

Payment Policy

You must make full payment for your trip at least a month before your departure date. Do note that without making full payment, your booking will not be completed and depending on the circumstances, your reserving may even be cancelled. Do note that we only accept payments in NPR, INR, and USD. Furthermore, you should also note that late payments can lead to cancellations without a refund. 

Changes To Bookings

Should you require to change your travel plans such as departure dates and/or itinerary, you must notify our representative at Kailash Vision Treks in writing. Furthermore, they are also subject to the following conditions. 

  • The changes must be made at least 60 days before the date of departure. 
  • Each change incurs a predetermined fee per person, which must be paid before the changes are confirmed. 
  • Changes requested under 60 days of departure are subject to availability and can include additional charges. 

Cancellation Policy

Although we do our best to ensure that you enjoy your holidays, we are not responsible for any cancellation because of any form of industrial dispute, technical failure of transport, loss of earnings, late arrival, or any other forms of mediums beyond our control. Once you have booked our services, should you need to cancel the pre-booked travel plans, you must notify Kailash Vision Treks in writing. Once we receive the writing, we shall refund your booking fund with a bit of cancellation charges redacted from the total amount. The specific amount of the cancellation fee depends on your specific travel plan. Furthermore, there are also circumstances where your booking fee shall not be refunded. These circumstances include: 

  • Force majeure events (natural disasters, political unrest, etc.).
  • Missed flights or transportation delays.
  • Failure to comply with health, visa, or documentation requirements.

Medical Disclosure 

By using our services, you provide us with a warranty that you have the physical and mental fitness to carry on with your trip. Furthermore, you also assure us that you are aware of the requirements for every matter concerning your physical and mental health. You also confirm that: 

  • You are in good physical and mental health.
  • You have disclosed any medical conditions, allergies, or fitness concerns that could impact your participation in the trip.

For high-altitude destinations like the Kailash Mansarovar Yatra, we strongly recommend consulting a doctor and obtaining a medical fitness certificate before travelling.

Should you fail to meet the health requirements but still continue to use our services, we shall not be held liable for any form of harm or discomfort faced during your tour and travel. 

Travel Documents And Visa Requirements 

It is your responsibility to ensure that you have all necessary travel documents, including passports, visas, and permits, before departure.

  • Passports must be valid for at least 6 months from the date of travel.
  • For certain destinations (e.g., Kailash Mansarovar Yatra), we assist in obtaining the required permits, but delays or rejections by the authorities are beyond our control.
  • You are responsible for any costs incurred due to incomplete or incorrect documentation.
  • Route Changes, Postponements, Cancellations, or Delays

Kailash Vision Treks reserves the right to:

  • Change the trip dates or modify any part of the itinerary.
  • Cancel or adjust any routes or destinations included in the tour.
  • Substitute alternative routes if any part of the trip is cancelled or modified.
  • Postpone, cancel, or delay any part of the tour due to bad weather, hazardous conditions, political instability, or other circumstances that might affect safety.
  • Cancel a tour if a government travel warning or advice is issued or changed.

In case of any changes, cancellations, delays, or modifications, there will be no refund of the tour price, and no compensation for any additional costs or inconvenience.

Kailash Vision Treks also reserves the right to cancel the tour if a participant fails to meet the required formalities or if they carry unlawful items such as drugs, firearms, political materials, etc. In such cases, the participant will be excluded from the tour without a refund.

Kailash Vision Treks will make final decisions in case of any disputes or issues during the trip.

Insurance 

Before you take any of our travel services, you must ensure that you have travel insurance. Furthermore, you must ensure that your travel insurance covers: 

  • Emergency medical expenses and evacuation
  • Personal liability
  • Loss or damage to baggage and personal belongings
  • Trip cancellations or interruptions
  • We do not provide insurance, and it is your responsibility to secure adequate coverage before departure.
  • Itinerant Changes And Force Majeure

We strive to follow the planned itinerary as closely as possible. However, due to circumstances beyond our control (e.g., bad weather, road closures, political unrest, or safety concerns), we may need to make adjustments.

  • We reserve the right to change routes, cancel activities, or modify schedules for the trip according to our needs.
  • If due to unforeseen circumstances, cancellation is made, no refund would be given.
  • Wherever possible, we shall offer equivalent alternatives in case of itinerary changes; however, any additional costs (if applicable) shall be held up by you.

Client Behaviour And Responsibilities

When taking our services, you, as a client of Kailash Vision Treks, also have a few responsibilities that you must follow. As a participant in our tours and trekkings, you are expected to follow the guidelines below:

  • Follow instructions provided by our guides and staff.
  • Respect local customs, cultures, and environmental regulations.
  • Avoid behaviour that could endanger yourself, fellow travellers, or staff.
  • Kailash Vision Treks reserves the right to remove any participant from the trip on grounds of misconduct, ill-legal activities, and failure to abide by the safety precautions.
  • No refunds will be issued in such cases.

Liability

As a tour and trekking operator in Nepal, Kailash Vision Treks acts as an intermediary between you and various forms of service providers such as hotels, airlines, transport operators, and more. That said, although we do our best to ensure high-quality services, we are not liable for the following:

  • Delays, cancellations, or changes caused by third-party service providers.
  • Loss, damage, or theft of personal belongings during the trip.
  • Injuries, illnesses, or accidents that occur during the trip.
  • We recommend that you carefully follow the safety guidelines provided by our staff to minimize risks.

Pricing And Surcharges

The prices mentioned in our package pages are the prices we offer, bar a few exceptions. However we do not guarantee that the said prices shall remain constant throughout the years. These prices are bound to change (either increase or decrease) in the future based on many circumstances. Some of the key circumstances where the prices are subject to change include:

  • Increases in fuel costs or taxes
  • Currency fluctuations
  • Changes in ground service fees
  • If such changes occur, we will notify you, and any difference in price must be paid before departure.
  • Respect local cultures, customs, and environmental regulations.
  • Do not engage in any activity that may put yourself, other travelers or staff in harm’s way.

Communication And Consent

When you make a booking or inquiry with us, you consent for us to contact you by:

  • Phone, and email. 
  • Notifications about bookings, payments, itinerary changes, and promotions

Your contact information will not be shared with third parties for marketing purposes without your permission.

Assumption Of Risk

By using our services, you agree to assume all of the risks associated with the journeys. You also agree to abide by the terms and conditions of Kailash Vision Treks as mentioned on this website. Should any form of accident happen, you shall not hold Kailash Vision Treks, our agents, associates, or employees for damages.You agree to and acknowledge that you travel at your own risk.

Safety and Emergency

Safety is the most important issue for us at Kailash Vision Treks so we have adopted all reasonably practicable safety precautions during your journey.

  • That said, do note that some of the trekking journeys can be a bit risky depending on the specifics of the circumstances. To reduce the risks, you must:
  • Inform us of any medical or personal concerns that could impact your safety.
  • You acknowledge that you are travelling at your own risk.

Safety And Emergencies

By agreeing to the usage of our trekking services, you also agree to: 

  • Listen for and follow all safety directions provided by our guides/staff.
  • In emergencies, our guides are trained to provide first aid and, if necessary, arrange evacuations. You will be responsible for any additional costs (e.g., helicopter evacuation, medical treatment).

Governing Law And Disputes

The laws of Nepal govern this agreement. Any disputes arising from these terms will be resolved through negotiation. If no resolution can be reached, the matter shall be referred to a court in Nepal.

Updates And Changes

We have the complete right to change the terms mentioned in these Terms And Conditions at our sole discretion without any prior notice. Therefore, we encourage you to periodically view the terms and conditions mentioned on this page. We shall not be held liable for any distress or harm caused by our service or website should you fail to view the changed terms and still continue to use our website and/or our services.

Feedback And Complaints

At Kailash Vision Treks, we highly value your feedback and aim to improve our services continuously. If you face any issues during your trip, feel free to notify your staff at your immediate convenience. Should you wish to file a formal complaint, we encourage you to do so within seven days of the trip completion in writing. We assure you that we will investigate and respond in a reasonable amount of time.
